RIGHTS AND OBLIGATIONS OF THE PARTIES
1. Rights and obligations of the CENTRE FOR CULTURAL AND SCIENTIFIC ACTIVITIES OF VAN MIEU – QUOC TU GIAM (Owner of the website vanmieu.gov.vn)
1.1. Rights of the Centre for Cultural and Scientific Activities of Van Mieu – Quoc Tu Giam
The CENTRE FOR CULTURAL AND SCIENTIFIC ACTIVITIES OF VAN MIEU – QUOC TU GIAM (hereinafter referred to as the "Centre") has the following rights:
- To issue, amend, supplement, and publish the Transaction Conditions, Regulations, Terms of Use, and other related policies of the website vanmieu.gov.vn.
- To post, update, and revise information about services, prices, promotional programmes, and the policies applicable on the website in accordance with the provisions of law.
- To provide, amend, update, suspend, or terminate part or all of the service for maintenance, system upgrade, or at the request of a competent State agency.
- To collect service fees according to the prices, payment methods, and policies published at the time the customer carries out the transaction.
- To require customers to provide the necessary, accurate, and lawful information in order to provide the service.
- To refuse to process, refuse to provide the service, or require the customer to supplement information where the registered information is incomplete, inaccurate, untruthful, or does not meet the conditions for using the service.
- To refuse to process, remove, or disable content uploaded by the customer if such content violates the law, the rights of a third party, or the Centre's policies, or poses a risk of affecting the safety and security of the system.
- To require customers to bear responsibility and compensate for damage if the customer's violation causes damage to the Centre or a third party in accordance with the provisions of law.
- To request the competent authority to resolve the matter, or to coordinate with a competent State agency, upon detecting a violation of law.
- To provide account information, data, and related documents to a competent State agency upon lawful request in accordance with the provisions of law.
- To own and protect all content, images, designs, trademarks, logos, data, software, and intellectual property objects belonging to the website vanmieu.gov.vn in accordance with the provisions of law. Any unauthorised reproduction, use, exploitation, or creation of derivative works is strictly prohibited.
1.2. Obligations of the Centre for Cultural and Scientific Activities of Van Mieu – Quoc Tu Giam
The Centre has the following obligations:
- To fully and accurately publish information about services, prices, promotional programmes (if any), payment methods, methods of service provision, and transaction conditions before the customer books the service.
- To establish and publish the procedures for booking, confirming, paying for, providing, and cancelling services, as well as for exchanges, refunds, and complaint resolution, so that customers may conveniently carry out transactions.
- To ensure that the website operates safely and stably within the scope of reasonable control; and to apply the necessary technical and managerial measures to ensure information security and protect customers' personal information in accordance with the provisions of law.
- To provide complete, truthful, and accurate information about the service; and to ensure that the quality of the service is consistent with the content published and agreed with the customer.
- To fully perform the obligation to provide the service in accordance with the agreement with the customer and the provisions of law.
- To refrain from trading in services belonging to sectors or trades in which investment and business are prohibited; and to refrain from infringing intellectual property rights or providing services prohibited by law.
- To provide valid receipts and vouchers (if any) in accordance with the provisions of law.
- To receive, process, and promptly resolve customers' requests, feedback, and complaints on the principle of openness and transparency and in accordance with the provisions of law.
- To fully perform tax obligations and other financial obligations in accordance with the provisions of law.
- To monitor and apply appropriate measures to prevent the misuse of the website for the purpose of committing violations of law; and to coordinate with and provide information and documents to competent State agencies upon lawful request.
- To support customers during the process of registration, payment, and use of the service within the scope of the Centre's responsibility.
- To keep customers' personal information confidential in accordance with the provisions of law and the Centre's Personal Data Protection Policy; and to refrain from unlawfully selling or exchanging customers' personal information with third parties, except where the customer consents or where otherwise provided by law.
Disclaimer of liability
- The Centre shall not be liable for service interruptions arising from causes of force majeure: natural disasters, epidemics, telecommunications infrastructure failures, requests of State agencies, or political and diplomatic events affecting the reception of visitors at the relic site.
- Content linking to third-party websites and social media (if any) is for reference only; the Centre shall not be liable for the content, privacy policies, or operations of such third parties.
2. Rights and obligations of the customer (the service user)
2.1. Rights of the customer
The customer has the following rights:
- To use the services provided by the Centre under the corresponding conditions of use.
- To have their personal information and private information protected in accordance with the provisions of law, having provided complete, accurate, and lawful information.
- To request the deletion of their account and/or related data in accordance with the provisions of law, the Privacy Policy, and the technical capabilities of the system.
- To be provided with complete and accurate information about prices, payment policies, methods of service provision, and transaction conditions before booking the service.
- To choose the service, payment method, and method of service provision published by the Centre.
- To request answers to enquiries and to submit feedback and complaints, and to have them considered and resolved in accordance with the Centre's policies and the provisions of law.
- To fully enjoy consumer rights in accordance with the provisions of law.
2.2. Obligations of the customer
The customer has the following obligations:
- To provide complete, accurate, truthful, and lawful information as required when registering an account, booking, and using the service; and to bear responsibility for the accuracy, truthfulness, and lawfulness of the information provided.
- To keep confidential their account information, password, and other authentication information. Where account information is disclosed due to the customer's fault, the customer shall bear responsibility for the risks and damage arising, to the extent permitted by law.
- To notify the Centre immediately upon detecting that their account or password has been used without authorisation, or upon detecting any act of infringing or breaching the security system.
- To make full and timely payment according to the chosen method.
- To use the service for the correct purpose and within the scope and conditions of the type of ticket purchased.
- To refrain from committing fraud or exploiting system errors or promotional programmes in order to gain unlawful benefits.
- To comply with the Transaction Conditions, Terms of Use, Privacy Policy, sales policy, and other regulations published by the Centre on the website.
3. Handling of violations and the customer's responsibility
Depending on the nature, degree, and consequences of the violation, the Centre has the right to apply one or more of the following measures: warning, refusal to provide the service, or requesting the customer to leave the relic site.
The handling of a violation does not exclude the customer's responsibility for the damage caused to the Centre or a third party.
The customer shall compensate the Centre and/or a third party for any damage, costs, complaints, or obligations arising from the customer's violation, to the extent permitted by law.
The Centre has the right to provide account information, data, and related documents to a competent State agency upon lawful request in accordance with the provisions of law.
The Centre's failure to immediately apply a handling measure to a violation shall not be construed as the Centre waiving its right to handle that violation in the future.
